These Terms of Use ("Terms") govern your access to and use of UptimeLuna's uptime-monitoring service, including this website and the dashboard at app.uptimeluna.com (together, the "Service"), operated by AK Cloud Systems ("UptimeLuna," "we," "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of an organization, you're agreeing on its behalf and confirming you have the authority to do so.
1. The Service
UptimeLuna checks the availability of websites, APIs, servers and other endpoints you configure ("Monitors") and alerts the contacts you designate when a Monitor's status changes. Features, check types, monitor limits and history retention vary by plan — see the pricing page for current details, which are incorporated into these Terms by reference.
2. Accounts
You need an account to use the Service. You're responsible for the accuracy of the information you provide and for safeguarding your credentials — enable two-factor authentication if you want an extra layer of protection, it's free on every plan. You're responsible for activity that happens under your account, including actions taken by teammates you invite on the Team plan.
3. Plans & billing
Free is free indefinitely, with no card required. Paid plans (Starter, Team) are billed monthly in advance through Stripe and renew automatically until cancelled. You can cancel any time from billing settings in the dashboard; you keep access to your plan's features through the period you've already paid for, after which your organization reverts to the Free plan's limits — over-cap monitors, status pages and seats are paused rather than deleted, and resume automatically if you upgrade again. We may change prices going forward; we'll give notice before a price change affects your subscription.
4. Acceptable use
You agree not to use the Service to:
- Monitor, probe, or otherwise send traffic to a target you don't own or don't have permission to test — a Monitor pointed at someone else's infrastructure without authorization is your responsibility, not ours.
- Use the Service as a denial-of-service tool, load-testing tool, or anything designed to degrade a third party's availability rather than observe it.
- Attempt to circumvent plan limits, rate limits, or the runner network's intended operation.
- Upload, configure, or transmit anything unlawful, infringing, or that violates a third party's rights through the Service (e.g. in a monitor name, contact label, or status-page content).
- Reverse-engineer, resell, or white-label the Service without our written agreement.
We may suspend or terminate an account that violates this section, with notice where practical.
5. Your content
You retain ownership of the configuration and content you put into the Service — monitor names, status-page copy, contact details, and the like. You grant us the license needed to store, process and display that content back to you (and, for anything you make public, like a public status page, to anyone who visits it) as part of operating the Service.
6. Service availability
We work to keep the Service reliable, but it's provided "as is" and "as available," without an uptime guarantee or SLA on the Service itself. Scheduled maintenance, third-party outages (hosting, DNS, our own sub-processors), and factors outside our control can affect availability. Monitor check results depend on your configured check interval and target's own behavior — the Service tells you what it observed, not a guarantee that your target was actually reachable by every visitor at every moment.
7. Disclaimers & limitation of liability
To the fullest extent permitted by law, UptimeLuna disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from your use of (or inability to use) the Service — including a missed or delayed alert, however caused. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose (or $50 USD if you're on the Free plan).
8. Third-party services
The Service relies on third-party providers — payment processing, SMS delivery, email delivery, and bot protection — to function. Their availability and performance are outside our control; see our Privacy Policy for who they are and what we share with them.
9. Termination
You may stop using the Service and delete your account at any time from account settings. We may suspend or terminate your access if you violate these Terms, or with reasonable notice for any other reason, including discontinuing the Service. Sections that by their nature should survive termination (billing for amounts already owed, disclaimers, limitation of liability) will survive.
10. Changes to these terms
We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above and, for significant changes, notify account holders by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws applicable to AK Cloud Systems, without regard to conflict-of-law principles, and any dispute will be handled in the courts of that jurisdiction, except where local law requires otherwise.
